Many an employer is starting to get nervous. In the period starting on 11 May 2020 and ending on 24 May 2020, elections must take place for the creation or renewal of works councils and committees. The election procedure takes a total of 150 days with a strict chronology. If the prescribed periods and dates are not followed, the elimination of the elections can be delayed afterwards.
So let's count: those who didn't start before Christmas missed the boat.
The first thing you should do is after to determine whether your company should organize elections. Note: In the context of the social elections, a company is defined as: "the technical business unit, defined on the basis of economic and social criteria". A company that employs an average of 50 employees must organize elections for a committee, a company that employs an average of 100 employees must organize elections for a works council. This average employee calculation is based on a reference period from 1 October 2018 to 30 September 2019.
If you are an employer who is to organize elections, you determine the date of the election in the period mentioned above and then count back to which obligations you have during the procedure. And there are a lot of them.
